This document outlines the standard terms and conditions governing photography services provided by DUCESTILLS. Scope of Work DUCESTILLS will provide photography services as outlined in the confirmed proposal, invoice, or booking agreement. Any work requested beyond the original scope may incur additional fees. Client Responsibilities The Client agrees to: Secure all necessary permissions, permits, and access for the chosen location. Ensure all subjects arrive on time and prepared. Communicate any schedule changes at least 24 hours prior to the session. Provide clear and accurate information about the session’s date, time, location, and desired goals. Failure to meet these responsibilities may affect the quality or quantity of deliverables, for which DUCESTILLS will not be held liable. Photographer Responsibilities DUCESTILLS will: Arrive on time and perform services professionally. Use their artistic judgment and technical skill to capture high‑quality images. Deliver edited images within the agreed‑upon timeframe. Retain backups of final delivered images via the virtual gallery for 30 days. DUCESTILLS is not responsible for: Weather, lighting conditions, or other external factors beyond their control. Missed moments or reduced shooting time caused by client tardiness. Styling, wardrobe, or appearance‑related issues unless specifically included in the service agreement Payment & Fees A non‑refundable retainer is required to secure a session date. All remaining balances must be paid by the session date unless otherwise agreed. Late payments may incur additional charges. Travel fees may apply for locations outside DUCESTILLS’ standard service area. Failure to pay may result in cancellation of services and withholding of final deliverables. Rescheduling & Cancellation Client‑initiated cancellations within 48 hours of the scheduled session may result in forfeiture of the retainer. Sessions may be rescheduled once without penalty if requested at least 24 hours in advance. DUCESTILLS reserves the right to reschedule due to illness, emergencies, unsafe conditions, or factors beyond their control. If DUCESTILLS must cancel and is unable to reschedule, all payments received will be refunded in full. Image Delivery Edited images will be delivered via digital gallery or download link. Standard delivery timeframe is 3–7 business days, depending on project type. Raw/unedited files are not provided unless purchased separately. Editing & Retouching Basic editing (color correction, exposure adjustments, composition adjustments) is included. Advanced retouching (skin smoothing, body modifications, object removal, etc.) may incur additional fees. Editing style is determined by DUCESTILLS’ professional discretion. Usage Rights & Ownership DUCESTILLS retains full copyright ownership of all images created. The Client is granted a non‑exclusive, royalty‑free license for personal or professional use depending on the service purchased. Images may not be sold, significantly altered, or used commercially without written permission from DUCESTILLS. DUCESTILLS may use images for portfolio, website, social media, and promotional purposes unless the Client opts out in writing beforehand. Liability DUCESTILLS is not liable for: Any injuries, damages, or incidents occurring before, during, or after the session. Loss of images due to equipment failure, natural disasters, theft, or unforeseeable circumstances. In such cases, liability is limited to the amount paid by the Client. Client Satisfaction Photography is subjective. DUCESTILLS will produce work consistent with their portfolio and industry standards. Re‑shoots are only offered in cases of equipment malfunction or demonstrable photographer error. Model Release Unless declined in writing, the Client grants DUCESTILLS permission to use images featuring them or their property for promotional and portfolio purposes. Agreement By booking a session or submitting payment, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
